Welcome to KiaOraCars.co.nz. These Terms and Conditions (“Terms”) govern your access to and use of our website and services (“Platform”). By using our Platform, you agree to be bound by these Terms. If you do not agree, please refrain from using the site.
1. Definitions
- “Platform” refers to kiaoracars.co.nz and all associated services.
- “User” means any visitor, buyer, seller, advertiser, sponsor, or account holder.
- “Listing” refers to any vehicle or advertisement posted on the site.
- “Dealer” refers to any business entity listing multiple vehicles.
- “Private Seller” refers to individual users listing one or more personal vehicles.
2. User Eligibility and Account Creation
- Users must be 18 years or older and legally able to enter contracts.
- Users must provide accurate and complete registration information.
- One account per user, unless otherwise authorized.
3. Platform Role
- KiaOraCars.co.nz is a listing platform only. We do not buy or sell cars.
- Buyers and sellers connect through the Platform and complete transactions externally.
- We are not a party to any contract for the sale of a vehicle.
4. Listings and Content
- Listings must be accurate, legal, and not misleading.
- No fraudulent, defamatory, infringing, or unlawful content.
- Vehicles listed must be legally owned and free from undisclosed encumbrances.
- Photos and descriptions must reflect the actual vehicle being sold.
- Contact information may only be included in approved fields.
5. Fees and Payments
- We may charge fees for listing upgrades, featured placements, and advertisements.
- Fees are non-refundable unless otherwise stated.
- Non-payment may result in account suspension or legal recovery.
6. Dealers, Advertisers & Sponsors
- Dealers must comply with applicable NZ vehicle dealer regulations.
- Advertisers and sponsors are responsible for the legality of their claims.
- Sponsored or promoted listings must be clearly marked.
- Any third-party tools (e.g., finance calculators, insurance links, history checks) are governed by their respective provider’s terms.
7. Disclaimers and Limitation of Liability
- We do not guarantee vehicle condition, availability, or accuracy of listings.
- Users assume full responsibility for due diligence and transactions.
- We disclaim all warranties to the extent permitted by NZ law.
- We are not liable for any direct, indirect, incidental or consequential losses.
8. Privacy and Cookies

9. Termination
- We may suspend or terminate access for breach of these Terms or illegal activity.
- Users may close their account at any time.
10. Changes to Terms
- We may modify these Terms with 14 days’ notice.
- Continued use of the Platform constitutes acceptance of changes.
11. Governing Law
- These Terms are governed by the laws of New Zealand.
